New Airbnb and Short Term Let Planning Regulations Ireland 2026: The 7-Year Rule and Retention Planning Permission Explained

Nov 5, 2026

Are you operating an Airbnb or short-term letting property in Ireland without planning permission? New planning regulations introduced in 2026 could make it easier to regularise your property through a simplified retention planning application.

The Irish Government has introduced significant changes to the planning rules governing Airbnb properties, holiday homes and other short-term rental accommodation.

One of the most important developments is the introduction of a seven-year planning policy that provides favourable consideration for certain established short-term letting properties.

In addition, new regulations introduced in September 2026 have simplified the retention planning application process, removing the requirement for detailed architectural plans and maps.

For Airbnb owners concerned about planning compliance, these changes may provide an important opportunity to regularise an existing short-term letting use.

What Are the New Airbnb Planning Regulations in Ireland for 2026?

The Planning and Development (Short Term Letting – Planning and Development Act 2000) (Change of Use) Regulations 2026, S.I. No. 500/2026, came into operation on 29 September 2026.

These regulations introduce a simplified administrative planning application procedure specifically for existing short-term lettings.

The principal changes include:

  • A dedicated application form for short-term letting retention planning applications.
  • No requirement to submit detailed architectural drawings or site maps under the simplified procedure.
  • A streamlined administrative application process.
  • Availability throughout Ireland, regardless of how long the property has operated as a short-term let.

This means that Airbnb owners who previously faced the expense of preparing conventional architectural planning drawings may now have access to a more straightforward retention planning application process.

What Is the New 7-Year Airbnb Planning Rule?

The new national planning policy provides a presumption in favour of granting planning permission for certain properties that have operated continuously as short-term lets for at least seven years.

This is particularly significant for established Airbnb operators who have been letting their properties for several years without specific planning permission for short-term letting.

However, the seven-year rule is not an automatic exemption from planning permission.

To benefit from favourable consideration, the following conditions are particularly important:

  • The property has been used continuously for short-term letting for at least seven years.
  • No planning enforcement action was taken during that period.
  • The proposed use would not create serious traffic, flooding or pollution risks.
  • The short-term letting use would not breach occupancy-related planning conditions attached to the property.

The relevant planning authority must still consider the application and decide whether retention planning permission should be granted.

If your Airbnb has operated for seven years or more, you may now have a more favourable route to obtaining retention planning permission.

Do I Automatically Have Planning Permission After Seven Years?

No.

A common misunderstanding is that operating an Airbnb for seven years automatically makes the use legal.

This is not the case.

The seven-year policy provides favourable consideration when a planning application is made. It does not automatically authorise an unauthorised change of use.

Property owners must still establish whether planning permission is required and, where necessary, submit a retention planning application to their local authority.

Can I Apply for Airbnb Retention Planning if I Have Operated for Less Than Seven Years?

Yes.

One of the important features of the new 2026 regulations is that the simplified short-term letting retention application process is not restricted to properties operating for seven years or more.

Owners who have operated an Airbnb for two, three or five years may also apply under the simplified procedure.

However, they will not automatically benefit from the specific seven-year presumption in favour of permission.

Their applications will be considered against the relevant planning policies, location, planning history and circumstances of the property.

Do I Need Architectural Drawings for an Airbnb Retention Planning Application?

Under the new simplified retention procedure introduced by S.I. No. 500/2026, detailed architectural plans and site maps are not required.

This is a significant change from conventional retention planning applications, which commonly require measured surveys, architectural drawings and detailed site mapping.

The new process is intended to reduce the administrative burden and cost for existing short-term letting operators.

Applicants must still provide the prescribed application information, supporting documentation and applicable statutory notices.

What Evidence Do I Need to Prove Seven Years of Airbnb Operation?

If you are applying for retention planning permission and wish to rely on the seven-year policy, evidence of the property’s operating history will be important.

Useful documentation may include:

  • Airbnb or Booking.com reservation and transaction records.
  • Historical short-term letting listings.
  • Revenue records showing rental income.
  • Bank statements showing rental payments.
  • Booking confirmations and guest records.
  • Cleaning, laundry or property management invoices.
  • Other dated documentation demonstrating the property’s continued use as short-term letting accommodation.

The stronger and more consistent the supporting evidence, the easier it may be to demonstrate the property’s operating history.

Seasonal operation or interruptions may require further consideration, particularly where continuous use is disputed.

What If My Airbnb Is Located in Dublin, Cork, Galway or Another Large Town?

The new planning policy distinguishes between larger urban areas and smaller towns.

In general, the policy restricts new short-term letting permissions in cities and towns with populations exceeding 20,000.

However, the seven-year presumption in favour of permission may still be relevant to established short-term letting properties in these locations, provided the qualifying conditions are satisfied.

This is particularly important for existing Airbnb operators in Dublin and other major urban areas who may otherwise face restrictive planning policies.

What Are the New Fáilte Ireland Airbnb Registration Requirements?

Separate from planning permission, the Government is introducing a national short-term letting registration system administered by Fáilte Ireland.

The published arrangements provide for registration opening on 1 December 2026, with hosts required to register by 31 December 2026.

The system applies to accommodation offered for short stays of up to 21 nights.

Property owners will be required to make declarations concerning planning and other applicable compliance requirements.

For properties located in towns with populations of 20,000 or fewer, the Government has announced a two-year period from 23 October 2026 to meet national planning compliance requirements.

Properties in larger towns and cities do not benefit from the same planning compliance lead-in period.

Airbnb registration and planning permission are separate requirements. Registering a property does not itself grant planning permission.

Do I Need Planning Permission to Rent a Room in My Own Home on Airbnb?

Not every Airbnb or short-term letting arrangement requires planning permission.

The letting of a room or rooms within a person’s principal private residence is generally exempt from planning permission under the applicable short-term letting provisions.

Homeowners may also qualify for an exemption when letting their entire principal private residence for up to 90 days in a year while temporarily absent.

Different requirements may apply where the property is a separate investment property, holiday home, apartment or dwelling used primarily for short-term letting.

The property’s circumstances and existing planning status must be considered.
